These terms and conditions, as may be amended from time to time, apply to all our services directly or indirectly (through distributors) made available online, through any mobile device, by email or by telephone. By accessing, browsing and using our website or any of our applications through whatever platform (hereafter collectively referred to as the "website") and/or by completing a reservation, you acknowledge and agree to have read, understood and agreed to the terms and conditions set out below (including the privacy statement).

 

These pages, the content and infrastructure of these pages, and the online accommodation reservation service provided on these pages and through the website (the "service") are owned, operated and provided by Gomfy ("Gomfy ", "us", "we" or "our") and are provided for your personal, non-commercial use only, subject to the terms and conditions set out below.

By using the website, private and professional third parties ("guest") can book accommodation and other travel services ("service(s)") at hosts and travel service providers ("service providers"). The hosts and service providers trade on their own behalf.

 

1. Using this website


With the usage of the Gomfy website, the user agrees to the conditions which will be explained in this statement. For providers, agencies and other business partners of the Gomfy there are separate terms of use defined, which the respective partner needs to agree to before starting business with Gomfy.

Before a user can book a service through the Gomfy website, it is mandatory that the user takes note of these terms of use and accepts them, becoming legally binded via ticking the check box during the log in and the booking process. The Gomfy will conveniently publish all amendments to these terms of use.

 

2. Before you book:

 

(i) Insurance

We strongly advised to all students to take out insurance in case of the need to return home early, medical conditions and other unpredictable circumstances.

(ii) Health declaration

If you have any illnesses, allergy or disability, this must be reported to the service providers at the time of confirmation of the booking.

(iii) Visa approval

It is responsibility of the student to arrange all applicable travel permits or visas and to have a valid passport. Gomfy is not responsible for determining whether or not student needs a visa. Visa regulations change from time to time therefore we strongly advise you to contact the relevant Embassy/Consulate in your country for up to date information. Guest required to be in possession of a visa to enter a country or territory should book the course and accommodation at least 8 weeks in advance.

 

 

 

3. Service description

(i) Scope

Gomfy makes available a platform or marketplace with related technology for guests and service providers to meet online and arrange for bookings of accommodations. The Gomfy acts as a booking engine and intermediary for the services provided. The Gomfy is not a party included in the agreement between the guest and the service provider, and has no responsibility or liability to the user in respect of the terms of the contract.

(ii) Effectiveness of the booking

The mediation of the booking service becomes effective when the guest pays a percentage (defined by the service provider - usually between 10% and 30%) of the total price of the booked services as a nonrefundable deposit to Gomfy. At that moment the guest obtains the right that the booked service will be delivered by the service provider within the stated time period. The deposit is non-refundable even if the student / guest does not use the booked service, regardless of who is responsible for the circumstances which have led to the disuse of the service.

(iii) Costs

The prices on our site are highly competitive. The placement service of the Gomfy is free of charge for the guests. The guest agrees in the case of a successful placement to pay the balance of 70-90% of the accommodation price plus taxes and charges directly to the service provider, according to the terms and conditions of the service provider.

 

4. Capacity to contract


On Gomfy service providers and guests must be persons able to legally contract, or persons who act with the consent of their legal guardian/representative.

 

5. Booking terms


The booking terms are equivalent to the terms and conditions of the service providers. The guest needs to accept the terms and conditions of the service providers prior to booking. The service provider is solely responsible for the correctness of the information in the terms and conditions. It is the responsibility of the guest to clarify any ambiguity about the terms and conditions of the service provider prior to the booking.

By making a reservation trough Gomfy with the service provider, you accept and agree to the relevant cancellation and refund policy of that particular the service providers, and to any additional (delivery) terms and conditions of the service providers that may apply to your reservation or during your stay, including for services rendered and/or products offered by the service providers (the delivery terms and conditions of a the service provider can be obtained with the relevant the service provider).
The general cancellation and refund policy of each service provider is made available on our website at the service provider information pages, during the reservation procedure and in the confirmation email. Please note that certain rates or special offers are not eligible for cancellation or change. Please check the course and or accommodation details thoroughly for any such conditions prior to making your reservation.

For the purpose of your booking "Lowest Price Guarantee" means the guarantee issued by Gomfy (under this or any similar name) that Gomfy offers the Lowest rate for an accommodation and in the event that a lower rate can be found online for the equivalent accommodation with the same start date and finished dates and the same booking conditions the service providers agrees to meet that lower price.

 

6. Guest obligation


The guest undertakes to handle the payment pursuant.
With regard to his or her contact details, including the data for payment handling, the guest undertakes to make truthful and correct statements.
The guest undertakes to recognize the conditions of cancelation offered by the service provider as part of the agreement between the service provider and guest. For the rest, the agreement between the guest and service provider can only be rescinded if both parties agree to this rescission and the approval is declared at least in text form by compliant e-mails.
The guest undertakes to recognize the “house rules” as part of the contractual conditions between the service provider and guest.
The guest undertakes to convince himself/herself of the identity of his/her contracting partner if necessary. Gomfy can only carry out a review of the data stored during registration to a very limited extent as the identification of persons in the Internet is only possible to a limited extent. Despite every efforts to the contrary, it is therefore not possible to exclude that false data have been stored for a user account.

 

7. Service delivery


The Gomfy informs the service provider about a guest's booking via e-mail. The guest receive from Gomfy a booking confirmation via e-mail on behalf of the service provider. Within the e-mails, each contracting party receives the contact data of the other party from the Gomfy database.

Service providers and guests shall agree on the details of the service delivery - particularly the arrival time, and the transfers and payment arrangements. With the exception of the details just stated, the individual contract conditions between service provider and guest are effective in the respective legal context.

 

8. Guest reviews


The completed guest review may be (a) uploaded onto the relevant service provider’s information page on our website for the sole purpose of informing (future) customers of your opinion of the service (level) and quality of the service provider, and (b) (wholly or partly) used and placed by Gomfy at its sole discretion (e.g. for marketing, promotion or improvement of our service) on our website or such social media platforms, newsletters, special promotions, apps or other channels owned, hosted, used or controlled by Gomfy. We reserve the right to adjust, refuse or remove reviews at our sole discretion. The student / guest review form should be regarded as a survey and does not include any (further commercial) offers, invitations or incentives whatsoever.

 

 

9. Liability


Accommodation and services offered on the websites of the Gomfy will be provided by third party service members. The Gomfy does not offer or provide its own accommodation or services except for the booking mediation between guests and service providers. The Gomfy is not liable for the correctness of the information given by guests and service providers. Furthermore the Gomfy is not liable if the service provider does not fulfill its duties derived from its terms of use, or if the guest is not satisfied with the service provider's performance for any other reason.

In the context of its booking mediation service the Gomfy is liable without restriction for damage caused in a wilful or grossly negligent manner by Gomfy, its employees and vicarious agents and in the malicious concealment of deficits, with the explicit assumption of warranty and for damage arising from injury to life, body and health.

Gomfy is only liable for other damage if an obligation is breached whose fulfilment makes the orderly implementation of the contract possible in the first place and whose compliance the contracting partner may regularly trust in (cardinal obligation). The compensation obligation is restricted to damage that can be seen as typical of the contract and foreseeable. Any liability pursuant to the product liability law remains unaffected. A liability of Gomfy that goes beyond the aforementioned is excluded.

The amount of liability is limited to the typically foreseeable damages at the time of the conclusion of the contract. This limitation is not valid for the intentional or negligent breach of duty by the Gomfy, or by a legal or affiliated agent of the Gomfy.

Liability for indirect damages, particularly loss of profit, exists only in the case of intentional or negligent breach of duty by a legal or affiliated agent of the Gomfy.

Under all other circumstances the Gomfy is not liable.

 

(i) Content


Our service is based on information provided by service providers, guests and users. Although we do our best effort to ensure that all information provided on this website is accurate, we cannot guarantee that all information is comprehensive and error-free, nor can we be held responsible for interruptions, inaccuracies, typographical errors or non-delivery of information. Service providers cannot be held responsible for any changes that arise or errors that might have occurred. Gomfy cannot be held liable for changes to any of the content, or products and services published on this website at any time without notice. In addition, Gomfy makes no representations or warranties to the accuracy or completeness of the information accessible via this site. All bookings for courses and accommodation services on this website are made directly with the service providers concerned and not with Gomfy. We only facilitate the making of reservations with the service providers. Gomfy is not a party to the contract between you and the service providers.
Prior to making a booking, you should ensure that you have reviewed the service providersl's terms and conditions and that they are acceptable to you. Gomfy shall in no way be liable to you in the event that the course or accommodation services are not suitable for your purpose and this is a matter to be dealt with between you and the service providers in question

(ii) Links to third parties sites

This website may contain hyperlinks to websites operated by parties other than Gomfy. Such hyperlinks are provided for your reference only, in order to offer you an additional facility of this site. Gomfy does not control such websites and is not responsible for their contents or links included on these pages, which are protected by third party copyright. The inclusion of hyperlinks on this website to such other websites does not imply any endorsement of the material on such websites or any association with their operators.

(iii) Copyright

No part of this internet site may be reproduced, wholly or in part, in any way, without obtaining the written consent of Gomfy.

 

10. Final provisions


The law of the Republic of Ireland applies, with the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG).

If the service provider is a merchant, legal entity under public law or a special fund under public law, the sole place of jurisdiction for all disputes arising from this agreement is Dublin. The same applies if the user does not have any general place of jurisdiction or place of residence in Republic of Ireland or the usual domicile is not known at the time the legal action is filed.

If individual provisions of the agreement with the user, including this provision, should be or become invalid in their entirety or in part, this shall not affect the validity of the remaining provisions. The same applies in the event of a lacuna.
